Terms of Service

These Terms of Service ("Terms") govern your access to and use of the realtimeavatar.ai website, platform, API, and SDK (together, the "Service"), operated by The Influence Company ("we", "us"). By creating an account or using the Service, you agree to these Terms.

Accounts

You must provide accurate account information and are responsible for activity under your account and API keys. Keep your server-side keys secret; never ship a live key to a browser. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

Acceptable use

You agree not to use the Service to:

• impersonate a real person without their clear, documented consent, or create deceptive deepfakes;
• generate content that is unlawful, harassing, hateful, sexually exploitative, or that infringes others' rights;
• violate the privacy or publicity rights of any individual, including by cloning a likeness or voice without permission;
• attempt to disrupt, reverse-engineer, or circumvent the Service's security, rate limits, or billing.

You are responsible for the avatars, prompts, audio, and other inputs you provide, and for your end users' use of avatars you deploy.

Plans, billing, and credits

The Service is offered on a free sandbox plan and paid plans. Paid plans include monthly realtime minutes and avatar creations; usage beyond included amounts draws from prepaid credits or metered overage at the rates shown on our pricing page. Fees are billed in advance and are non-refundable except where required by law. We may change prices with notice for future billing periods.

Intellectual property

You retain ownership of the content you submit and the avatars you create. You grant us a limited license to process that content solely to operate the Service. We retain all rights in the Service, the SDK, and our models and software.

Service availability and disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve months before the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to the Service. Provisions that by their nature should survive termination will survive.

Changes

We may update these Terms from time to time. Material changes will be posted here with an updated date; your continued use after changes take effect constitutes acceptance.
